I. GENERAL TERMS AND CONDITIONS

​§ 1 SCOPE OF APPLICATION AND PROVIDER

(1) The following General Terms and Conditions apply to all contracts concluded with me as the provider (Josephin Oehme) via my website.

(2) The offer is directed exclusively at consumers within the meaning of § 13 of the German Civil Code (BGB).
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

(3) Deviating terms and conditions of customers shall not be recognised unless I expressly agree to their validity in writing.

 

§ 2 SUBJECT MATTER OF THE CONTRACT

(1) The subject matter of the contract may include:

  • Digital content (e.g. e-books, downloads, audio or video content),

  • Online services such as workshops, courses, or comparable formats,

  • Psychological consulting / trauma counselling (online).

(2) The services provided do not constitute psychotherapy or medical treatment.

§ 3 CONCLUSION OF CONTRACT

(1) The presentation of services on the website does not constitute a legally binding offer but an invitation to place an order.

(2) A contract is concluded once you complete the order process and receive a confirmation email, or when an appointment is bindingly confirmed.

(3) Digital products are made available after receipt of payment.

§ 4 PAYMENT AND DUE DATE

(1) The prices stated are final prices pursuant to § 19 UStG (small business regulation – no VAT is charged).

(2) Payment is due immediately upon conclusion of the contract unless otherwise agreed.

(3) Available payment methods are indicated in the respective offer.

§ 5 DIGITAL CONTENT

(1) Digital content is provided in the form described in the respective offer.

(2) Upon purchase, you receive a simple, non-transferable right of use for personal purposes only.

(3) Distribution, reproduction, or public accessibility is not permitted.

§ 6 ONLINE CONSULTING / TRAUMA COUNSELLING

(1) Consulting services are provided exclusively online.

(2) The services do not replace medical, psychiatric, or psychotherapeutic treatment.

(3) Responsibility for personal psychological stability remains with the client. In cases of acute crisis, clients are advised to seek medical or therapeutic professional support.

§ 7 RIGHT OF WITHDRAWAL

(1) Consumers generally have a statutory right of withdrawal.

(2) In the case of digital content, the right of withdrawal expires once performance of the contract has begun and you have expressly consented to this (§ 356 para. 5 BGB).

(3) For fixed appointments (e.g. consultations, workshops), there is no right of withdrawal once the appointment has taken place.

§ 8 LIABILITY

(1) The statutory provisions on liability apply.

(2) In cases of slight negligence, liability is limited to breaches of essential contractual obligations.

(3) Liability for health-related or psychological consequences is excluded to the extent permitted by law.

§ 9 FINAL PROVISIONS

(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.

I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
